Thomas A. Kroeger

Drawing on his extensive experience in federal and state courts, Thomas Kroeger focuses on complex litigation and appellate practice. Equally comfortable in front of a jury or an appellate court, Mr. Kroeger tries cases and argues appeals in state and federal courts in Florida (and across the country). He relishes the opportunity to tackle thorny legal issues and deliver “must-win” moments for his clients.

Bio

Curious at heart, Thomas Kroeger welcomes challenging cases and novel issues. Some of the more notable cases he has worked on include:

  • $450 million in four judgments in a first-of-its-kind action brought under Title III of the LIBERTAD Act (Havana Docks v. Carnival, Royal, NCL, and MSC) who trafficked in the confiscated property of a U.S. national company.
  • Successful class actions brought on behalf of hospital-based pathologists against HMOs and PPOs that have collectively recovered millions in unpaid professional fees.
  • Serving as lead appellate counsel in a pending Eighth Circuit appeal challenging the application of an Arkansas recreational use immunity statute in a Federal Tort Claims Act case.
  • Participating on a trial team that successfully obtained one of the first negligence verdicts in a wrongful death action against Tesla.
  • Serving as lead appellate counsel in criminal prosecution which successfully upheld the lower court’s dismissal of charges against a former public official for violations of Florida’s Government-in-the-Sunshine law.
  • Serving as lead appellate counsel in a Florida Supreme Court ethics case which successfully applied the newly recognized “hot potato” doctrine in conflicts of interest.

Mr. Kroeger cut his teeth on jury and bench trials, trying well over two dozen during his time as an assistant public defender at the Miami-Dade County Public Defender’s Office. Turning his eye toward appellate practice, he joined The Florida Bar’s lawyer-regulation division where he successfully handled scores of appeals before the Florida Supreme Court. In addition to state court appeals, Mr. Kroeger has had oral argument before both the Eleventh and Eighth Circuit Court of Appeals. 

As a strong proponent of clear yet impactful writing, he is often called upon to handle critical motions, including summary judgment and Daubert motions. However, Mr. Kroeger also loves the thrill of a trial and is just at home cross-examining a witness or delivering a closing argument. Finally, given his keen interest in legal ethics, he often speaks on issues of professionalism and civility.

A native of the Midwest, Mr. Kroeger graduated from the University of Iowa with Honors and Highest Distinction. After graduating from the University of Iowa College of Law, he passed the Florida, Iowa, and Illinois Bars. Having endured enough snow and cold weather, Florida won out, and Mr. Kroeger has called the state home since 2008.
