What Is Happening With These Cases Now?
At Colson Hicks Eidson, we have previously reported that the Judicial Panel on Multidistrict Litigation has consolidated 15 lawsuits and more than 125 “tag-along” cases concerning lawsuits centered around the makers of Zantac and generic ranitidine. Multidistrict litigation is used when there are several cases closely related to the same issue. The Zantac cases have been assigned to US District Judge Robin Rosenberg in Miami, Florida.
According to the transfer order, another 126 cases are pending in 21 districts across the country, and many others are expected to be filed.
These cases all stem from an announcement by the US Food and Drug Administration (FDA) confirming the presence of trace amounts of a potentially cancer-causing carcinogen in Zantac and similar generic ranitidine. The chemical at the heart of this matter is called N-nitrosodimethylamine (NDMA). The FDA has said that the safe daily intake limit for humans of NDMA is 96 nanograms. However, testing completed by independent labs discovered that the Zantac 150 mg tablets (the most common dosage) contained more than 2,500,000 nanograms of NDMA.
What Happens Moving Forward?
US District Judge Rosenberg has choices to make. After the discovery process is completed in these cases, the judge will select several individual lawsuits to proceed as “bellwether trials” in these cases. Initial trials allow both sides in these cases to predict how other lawsuits within the multidistrict litigation will proceed. When a drug company loses most of their bellwether trials, they often moved to reach settlements with consumers more quickly.
