In 2018, company 3M settled a lawsuit with the United States government for $9.1 million. 3M manufactured earplugs, specifically the Combat Arms Earplugs, Version 2 (CAEv2), and sold them to the United States military. The lawsuit was brought under the False Claims Act and alleged that the combat earplugs were defective. It also alleged that 3M had known about the defect since 2000, leaving it undisclosed to the military and falsifying a certification that the earplugs complied with military standards.
3M’s settlement with the government does not cover damages to the military men, women and contractors who used these earplugs and suffered serious hearing-related ear injuries. United States servicemembers, veterans and military contractors who have been injured have the right to pursue compensatory damages against 3M.
