Army Veteran Obtains $8.3 Million in VA Hospital Medical Malpractice Lawsuit

November 29, 2013 / 8:00 am

According to The Centre Daily, a U.S. veteran who lost a leg and suffered severe brain damage due to a VA hospital’s extreme negligence has been awarded $8.3 million in a professional malpractice lawsuit.

The then 43-year-old man went to St. Louis’ John Cochran VA Medical Center in 2009 to have a cardiac stent inserted after experiencing chest pain. One week later, the veteran returned to the hospital after developing an infected artery in his right leg, which later had to be amputated. The man stated in the lawsuit that surgeons negligently used infected tissue to repair the damage to his leg and waited too long to perform the corrective surgery. His significant blood loss caused him to sustain severe brain damage. The veteran and father is now paralyzed and finds it very difficult to communicate.

John Cochran VA Medical Center has a history of negligence. A Florida man sued the hospital in February of this year after he received months of unnecessary radiation and chemotherapy after being misdiagnosed with lymphoma. In 2011, the hospital shut down its operating rooms after rust stains were discovered on surgical equipment. A nurse in the intensive care unit was banned from treating patients after injecting one patient with a potentially lethal dose of a painkiller.

Colson Hicks Eidson has secured key rulings on behalf of the family of Cristian Fernandez in a wrongful death lawsuit arising from a 2023 collision between a Fisher Island ferry and a recreational vessel in Miami’s Government Cut.

During a September 1 hearing, Eleventh Judicial Circuit Judge Abby Cynamon granted the estate’s motion for partial summary judgment, finding that the defendant was operating and in control of the recreational vessel when it collided with a Fisher Island ferry. Cristian, a 27-year-old passenger aboard the recreational vessel, tragically lost his life in the collision.

The court also denied the defendants’ motion for partial summary judgment regarding the ferry, finding that the evidence concerning any alleged navigational rule violations was disputed.

Colson Hicks Eidson partner Thomas A. Kroeger argued the motions on behalf of Cristian Fernandez’s estate. Tom and partner Julie Braman Kane represent the Fernandez family in the litigation.

Colson Hicks Eidson is proud to continue representing the Fernandez family in seeking justice for Cristian.
