Various studies have now indicated that Allergan textured breast implants increase the risk of breast implant-associated anaplastic large cell lymphoma (BIA-ALCL). In a recall letter sent to patients, Allergan offered to replace the textured breast implants with non-textured implants at no cost. However, this recall letter does not advise women that they are required to sign a release in order to get this free switch from the harmful implants. This release would effectively prevent any further legal action a woman may need to take against the company for damages. This letter also does not inform women of their rights to pursue additional claims for damages against the company. It seems that Allergan is attempting to appear gracious, but tricking women into signing a release absolving the company of any future actions they can take should they suffer harm due to Allergan’s negligent actions.
