Allergan’s Recall Leads to More Disturbing Findings for Textured Implants

In the wake of Allergan’s recall of their textured breast implants, new research is emerging that textured implants may be linked to breast cancer recurrence and worse breast cancer outcomes. According to JAMA Surgery, a medical journal, a “statistically significant association” is shown using textured implants. I want to be clear; this is separate data from the FDA’s findings that Allergan’s textured breast implants are linked to BIA-ALCL (Breast Implant-Associated Anaplastic Large Cell Lymphoma.)

The Disturbing Evidence Calls for a Worldwide Abandonment of Textured Implants

The research coming out on textured implants comes after Allergan has issued a recall of their textured breast implants.  JAMA Surgery conducted their study with 650 women diagnosed with breast cancer. They were in the early stages, had mastectomies and implant reconstruction.

  • 413 of the implants were textured, while 274 used smooth implants.
  • 4% of women had breast cancer recurrence in 4.5 years after their follow up.
  • 2.2% of women with smooth implants did not survive.
  • 6.7% of women with textured implants did not survive.

Michael Cassidy, M.D., and Daniel Roh, M.D., from the Boston University School of Medicine suggest “these risks make a case for stopping the use of textured implants.” This research adds more risks to textured implants. According to the FDA, 36 women have died from BIA-ALCL.  BIA-ALCL has led to a worldwide recall for Allergan’s textured implants, Biocell. A federal judge in Florida denied UnitedHealthcare’s motion to dismiss a lawsuit brought by a cancer patient seeking coverage for proton beam radiation therapy to treat his tongue cancer. The patient, Carlos Morera, alleges the insurer wrongfully denied benefits under his healthcare plan, forcing him to pay approximately $195,000 out of pocket for the treatment.

Stephanie A. Casey, a partner at Colson Hicks Eidson, represents Morera and successfully argued that the case should proceed.

“We look forward to presenting the merits of this case at trial. Proton beam radiation therapy has long been recognized as the standard of care for these types of cancers,” she said.

The U.S. Attorney’s Office for the Southern District of Florida has launched a new Whistleblower Non-Prosecution Pilot Program. It reinforces the recent efforts of the Department of Justice Criminal Division’s new Corporate Whistleblower Awards Pilot Program.

The local pilot program offers non-prosecution agreements in exchange for the early and voluntary self-disclosures of criminal conduct.  The Department’s pilot program offers financial rewards to a whistleblower who provides original and truthful information about corporate misconduct that results in a successful forfeiture.
