According to the Daily Business Review, two Colson Hicks Eidson attorneys recently helped a man trapped and seriously injured in a storage unit receive $4.956 million in damages.
A then 66-year-old retired Boca Raton contractor went to a Sunshine Storage Inc. facility in Deerfield Beach in January of 2009. At one point while the 66-year-old was in a unit, the metal roof collapsed. The weight of the roof and the contents from a second storage loft totaled 1.5 tons. The man was trapped alone inside the unit, and an emergency medical team had to free the trapped man. He was taken to North Broward General Hospital for emergency treatment.
The 66-year-old suffered a broken pelvis and other bone and joint injuries. The injured man went through rehabilitation for months, and his injuries left him significantly more impaired than before the injury. He now uses a walker or cane to get around, and is often in a wheelchair.
Colson Hicks Eidson attorney Deborah J. Gander alleged the roof was not properly supported with bracing or bolts due to Sunshine failing to properly draft and get building code approval for the facility; the jury agreed and granted the injured 66-year-old $4.956 in damages.
On December 9, the judge denied the Sunshine Storage’s motion for new trial. A final judgment is expected to be made in January of next year.
