Some businesses in South Florida will share in a $4.9 class action settlement that consisted of approximately nine thousand class members. The class action alleged that GE Capital IT Solutions and IKON Financial Services & Office Solutions raised the lease agreements on their copiers by five percent, in violation of the written lease agreements.
According to the plaintiffs’ Florida class action lawyer, the contracts were multi-year contracts at a fixed rate. Despite this, the defendants tried to raise the amount in the written lease agreement. Under the lease agreements, any increase was illegitimate.
A Florida judge approved the final settlement, and class members can draw compensation from a monetary fund. Class members can also object to any raises in their lease payments, which require the defendants to revert the lease contract to its original rate.
As part of the settlement, the defendants deny any wrongdoing, but they agreed to the settlement to avoid the burden, expense and risks of further litigation.
