A tragic boating accident last year in San Diego that claimed the lives of two men has resulted in a lawsuit against the boat manufacturer and the boat’s operator. In a report at 10news.com, 10 people were aboard the boat earlier this year on San Diego Bay. The boat capsized sending everyone into the water.
A 73-year-old man and his 48-year-old son drowned in the accident. Family members filed their lawsuit late last year, claiming the operator allowed too many passengers aboard. An earlier investigation by the San Diego Harbor Police found that the boat was overloaded at the time of the accident. The family is also suing the boat manufacturer for warning that was allegedly missing from the boat. The manufacturer said decals on the boat instruct how to fill the ballast tanks to prevent tipping and ensure self-righting of the boat. The family’s attorney said the decals were not on the boat at the time of the fatal accident.
The boat manufacturer is MacGregor Yacht Corp. The sailing trip that day was for people with special needs and developmental disabilities, according to the report.
